A Malpractice Claim against the James A. Haley Veterans Hospital must first be presented in writing with proper supportive documentation to the proper person and department within the Veterans Administration for an administrative review. The claim must be presented within the two-year statute of limitations. The VA will then have 6 months to conduct its review, during which time it may ask for additional supporting information. At the conclusion of the administrative review, if the claim is not settled, then a malpractice lawsuit should be filed in the United States District Court for the Middle District of Florida.
